Terms of Service

These Terms of Service (“Terms”) govern your access to and use of optioPDF (“Service”), operated by Cataphract (“we”, “us”, or “our”) at optiopdf.cataphract.dev. By accessing or using the Service you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

optioPDF provides a PDF text extraction API (“API”) that allows developers to extract text from PDF documents using native extraction and optical character recognition (OCR) techniques. The Service includes a web dashboard for managing API keys, monitoring usage, and configuring webhooks.

3. Demo Mode & Usage Limits

During the pre-launch demo period, all accounts are subject to a lifetime balance of 50 pages. This limit exists while payment processing is being configured. Once the Service launches commercially, paid plans with higher limits will become available. We reserve the right to change demo limits at any time.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity that occurs under your account. Notify us immediately at legal@cataphract.dev if you suspect unauthorised access.

5. Acceptable Use

You agree not to:

  • Upload documents you do not own or do not have the right to process.
  • Use the Service in violation of any applicable law or regulation.
  • Attempt to reverse-engineer, disassemble, or circumvent any security measures of the Service.
  • Use the Service to process content that is unlawful, harmful, defamatory, or violates third-party rights.
  • Resell, redistribute, or sublicense the Service without our prior written consent.
  • Conduct automated attacks, denial-of-service, or abuse the API in a manner that degrades service for others.

6. API Keys & Security

API keys are personal to your account and must be kept confidential. You are solely responsible for any use of an API key issued to your account. We may revoke API keys at any time if we reasonably suspect misuse.

7. Intellectual Property

The Service, including its software, design, and documentation, is owned by Cataphract and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. You retain all rights to the documents you upload and the extracted text output.

8. Privacy & Data Processing

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Uploaded PDFs are stored temporarily for processing and deleted in accordance with the data retention policy of your plan.

9. Billing & Payments

Paid plans (when available) will be offered through LemonSqueezy as our Merchant of Record. Prices are displayed inclusive of any applicable taxes. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with LemonSqueezy’s refund policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EXTRACTION RESULTS WILL BE PERFECTLY ACCURATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CATAPHRACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Service at any time for cause, including breach of these Terms. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our data retention policy.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
